1.1. These terms and conditions (hereinafter referred to as the "Terms and Conditions") define the rules and conditions for the provision of photography services by Sandra Dolata, conducting business activity under the name "Sandi Studio Photography" (address of the permanent place of business activity: Unit A, 1 Crown Gate, DT1 3FW Poundbury), entered into the Central Register and Information on Economic Activity kept by the minister competent for economy, holding UTR: 1540636977 (hereinafter referred to as the "Photographer").
1.2. Contact with the Photographer is possible via:

Agreements for the provision of photography services by the Photographer (hereinafter referred to as the "Session Agreements") are concluded via the internet functionality of the "Mafelo" platform (hereinafter referred to as the "Platform"), the terms and conditions of which are available at the address: https://www.mafelo.com/regulamin/ (hereinafter referred to as the "Platform Terms and Conditions").
1.4. The terms used in the Terms and Conditions written with a capital letter have the meaning given to them in the Platform Terms and Conditions, unless the Terms and Conditions expressly provide otherwise.
1.5. Before concluding the Session Agreement, the Client is obliged to read the Terms and Conditions and the Privacy Policy.
1.6. Providing content of an illegal nature by the Client is prohibited.
2.1. Deposit and Payment Schedule2.1.1. A non-refundable deposit is required at the time of booking to secure your session date. 2.1.2. The deposit amount will be clearly specified during the booking process and is payable via our booking platform using credit/debit card or PayPal. 2.1.3. The remaining balance is due on the day of the session. 2.1.4. Final payment can be made by: - Cash - Credit/debit card - Bank transfer (details will be provided) 2.1.5. All prices are in British Pounds Sterling (GBP).
2.2. Late or Failed Payments2.2.1. If the final payment is not received on the day of the session, the Photographer reserves the right to withhold the delivery of any images until full payment is received. 2.2.2. Any bank charges or fees incurred due to failed payments will be the responsibility of the Client.
3.1. Arrival and Session Time3.1.1. Clients are requested to arrive 5-10 minutes before their scheduled session time. 3.1.2. Late arrivals may result in reduced session time to accommodate subsequent bookings. 3.1.3. Sessions will end at their scheduled time regardless of late arrival.
3.2. Studio Environment3.2.1. The studio provides a climate-controlled environment suitable for photography. 3.2.2. Basic changing facilities are available for clients. 3.2.3. Limited secure storage is available for personal belongings during the session.
3.3. Health and Safety3.3.1. Clients must follow all safety instructions provided by the Photographer or studio staff. 3.3.2. Any equipment or props provided by the studio must be handled with care and as directed. 3.3.3. The studio maintains appropriate liability insurance for client safety. 3.3.4. Clients must inform the Photographer of any health conditions that may affect the session.
3.4. Props and Equipment3.4.1. Studio-provided props and equipment are available for use during the session at no additional charge. 3.4.2. Clients may bring their own props subject to prior approval. 3.4.3. Any damage to studio equipment or props caused by the Client will be charged at replacement cost.
4.1. The conclusion of the Session Agreement via the Platform may take place by: 4.1.1. The Client's acceptance of the date and other conditions for conducting the session (including the Photographer's remuneration) made available to the Client by the Photographer; 4.1.2. The Client's selection of the date and other conditions for conducting the session (including the Photographer's remuneration) from among the options made available to the Client by the Photographer.
4.2. Session Delivery4.2.1. Specific session details, duration, and deliverables are as described in the session information provided during booking. 4.2.2. Any variations from the standard session package must be agreed in writing before the session. 4.2.3. Final edited images will be delivered within 14 working days of the session. 4.2.4. Images will be provided in high-resolution digital format via secure download link. 4.2.5. The download link will remain active for 14 days.
5.1. Cancellations5.1.1. The deposit paid at booking is non-refundable. 5.1.2. Cancellations made less than 24 hours before the session time will be charged at full session rate. 5.1.3. Force majeure events will be considered on a case-by-case basis.
5.2. Rescheduling5.2.1. Sessions may be rescheduled without penalty if requested at least 24 hours before the scheduled session time. 5.2.2. Rescheduling requests made less than 24 hours before the session will be considered on a case-by-case basis. 5.2.3. The Photographer reserves the right to reschedule sessions in cases of illness, emergency, or equipment failure, and will make every effort to provide alternative dates.
5.3. Late Arrival5.3.1. If a Client arrives more than 15 minutes late for their session, it may be treated as a cancellation at the Photographer's discretion. 5.3.2. The Photographer will wait up to 15 minutes beyond the scheduled start time before considering the session cancelled.
6.1. The provisions of this section apply only to Clients who are Consumers or Entrepreneurs on consumer rights.
6.2. Pursuant to the Consumer Contracts Regulations 2013, the Client has the right to withdraw from the Session Agreement without giving any reason within 14 (fourteen) days from the date of its conclusion.
6.3. The Client exercises the right to withdraw from the Session Agreement by submitting a declaration of withdrawal from the Agreement to the Photographer. To meet the deadline for withdrawing from the Session Agreement, it is sufficient to send the declaration before the expiry of the period referred to in section 6.2.
6.4. The Photographer informs, and the Client acknowledges, that the right to withdraw from the Session Agreement does not apply if: 6.4.1. The subject of the Session Agreement is the delivery of Photos to the Client in physical form, or 6.4.2. The subject of the Session Agreement is the delivery of Photos to the Client in digital form (not saved on a tangible medium), and the Photographer has provided the Photos to the Client with their prior consent.
6.5. Alternative Dispute Resolution (ADR): 6.5.1. While Sandi Studio Photography is not currently a member of a specific ADR scheme, we are committed to resolving disputes amicably. 6.5.2. In the event of a dispute that cannot be resolved directly, consumers can contact The Ombudsman Services (https://www.ombudsman-services.org/).
7.1. Data Collection and Usage7.1.1. We collect and process personal data in accordance with the UK GDPR and Data Protection Act 2018. 7.1.2. Personal data collected includes: - Name and contact details - Booking and payment information - Photographs and session details - Marketing preferences
7.2. Data Storage and Security7.2.1. Your personal data is stored securely using industry-standard encryption and security measures. 7.2.2. Images are stored securely for a period of 30 days after delivery of final files. 7.2.3. Backup copies of delivered images are maintained for 90 days.
7.3. Data Sharing7.3.1. Your personal data will only be shared with third parties necessary for service delivery. 7.3.2. We will never sell your personal data to third parties.
7.4. Your Rights7.4.1. You have the right to: - Access your personal data - Request corrections to your data - Request deletion of your data - Withdraw marketing consent 7.4.2. To exercise these rights, contact us at hello@sandistudio.com
8.1. The Client may submit a complaint if they find that the Session Agreement has not been performed or has been improperly performed.
8.2. The Client submitting a complaint should send an email to the Photographer's address containing: 8.2.1. Client's first and last name 8.2.2. Email address 8.2.3. Date of the session 8.2.4. Description of the irregularities found 8.2.5. Proposed method of handling the complaint
8.3. The deadline for considering the complaint and responding to it is 14 (fourteen) days from the date of its receipt by the Photographer.
9.1. The Photographer is the sole owner of the economic copyrights to all photos taken under the Session Agreement.
9.2. The Client receives a non-exclusive license to use the photos for private, non-commercial purposes, without the right to further distribute or resell them.
9.3. The use of photos for commercial purposes, including publication in social media or advertising materials, requires the written consent of the Photographer.
9.4. The Photographer reserves the right to use the photos in their portfolio, on the website, in social media and promotional materials, after obtaining the Client's consent. The Client has the right to refuse consent to the use of photos for marketing purposes, without giving a reason.
10.1. The Photographer's liability for any loss or damage arising from the provision of the photography services shall be limited to the total value of the Session Agreement, except in cases of death or personal injury caused by the Photographer's negligence or breach of contract.
10.2. The Photographer maintains professional indemnity and public liability insurance.
11.1. These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales.
11.2. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the English courts.
12.1. In matters not regulated in the Terms and Conditions, the provisions of the Platform Terms and Conditions shall apply.
12.2. The current version of the Terms and Conditions is valid from 28th October 2024.
